Terms of Service

1. Acceptance of terms

By creating an account or using the Agentia service, you agree to be bound by these Terms of Service. If you do not agree, do not use the service.

2. Service description

Agentia provides AI-powered customer service agents that operate over WhatsApp, including knowledge ingestion, message handling, and inbox tools. The service is provided on an "as is" basis without availability guarantees beyond reasonable best effort.

3. Eligibility and accounts

You must be at least 18 years old and represent a legitimate business. You are responsible for keeping your credentials secure and notifying us promptly of any unauthorized access. Personal/consumer use is not supported.

4. Pricing and payment

Plans start at €49 per month. Billing is monthly in advance. We may change pricing with at least 30 days' notice; the new price applies from the next billing cycle. Late payment may result in service suspension.

5. Acceptable use

You agree not to use Agentia to send unsolicited messages (spam), distribute illegal content, impersonate others, harass recipients, or violate WhatsApp's Terms of Service. You are responsible for ensuring your messaging complies with applicable consent and opt-out requirements.

6. Intellectual property

Agentia LLC owns all rights to the platform, software, brand, and documentation. You retain ownership of the knowledge files and customer data you provide and grant us a limited license to process them solely to operate the service for you.

7. AI limitations

AI agents may produce incorrect, incomplete, or unexpected answers. You are responsible for reviewing agent behavior, monitoring conversations, and supervising the agent's outputs. Agentia LLC is not liable for losses arising from AI-generated answers.

8. WhatsApp dependency

Agentia operates over WhatsApp, a third-party service. Outages, policy changes, account restrictions, or other actions taken by WhatsApp are outside our control. We do not guarantee uninterrupted access.

9. Modifications and termination

We may modify these terms at any time with at least 30 days' notice. Continued use of the service after the effective date constitutes acceptance. We may suspend or terminate accounts that violate these terms. You may cancel your subscription at any time from your billing settings; cancellation takes effect at the end of the current billing period.

10. Refund policy

On cancellation, we issue a pro-rated refund for unused days of the current billing period, less any non-refundable payment gateway fees.

11. Limitation of liability

To the maximum extent permitted by law, Agentia LLC's total aggregate liability for any claim is limited to the amount you paid for the service in the 12 months preceding the claim. We are not liable for indirect, incidental, special, or consequential damages.

12. Governing law

These terms are governed by the laws of the United States and the applicable state laws. Any dispute arising out of or relating to these terms shall be resolved exclusively in the competent state and federal courts of the United States.
